These Rules define the procedure for the preparation, review, and adoption of amendments to the Cooperation Agreement between tourist industry enterprises and professional associations, as well as other organizations engaged in tourism activities in the member states and dialogue partner states of the Shanghai Cooperation Organization (SCO).
1. General Provisions
1.1. Amendments to the Agreement may be initiated by any participant of the Agreement.
1.2. Proposals for amendments shall be formulated in written form and submitted to the Executive Council for review.
1.3. Amendments must not contradict the goals and principles of the Agreement, SCO international documents in the field of tourism, or the legislation of the states in which the participants of the Agreement are located.
2. Procedure for Submitting Proposals
2.1. A participant proposing an amendment submits to the Executive Council:
the text of the proposed amendment;
justification for the proposed change;
anticipated implications and expected outcomes.
2.2. The Executive Council ensures that the proposals are communicated to all participants of the Agreement for discussion.
2.3. Participants are entitled to submit their comments, remarks, and alternative versions of the proposed amendments within the time frame established by the Executive Council.
3. Review of Amendments by the Executive Council
3.1. The Executive Council discusses the proposed amendments, including their expediency, potential implications for participants, and compliance with the objectives of the Agreement.
3.2. For a comprehensive review of amendments, the Executive Council may:
engage experts and consultants;
conduct consultations with participants;
establish working groups.
3.3. Following the discussion, the Executive Council submits the amendments for voting by the participants of the Agreement.
4. Procedure for Adopting Amendments
4.1. Amendments to the Agreement are adopted through a general vote of participants by a simple majority of votes, collected in the form of a survey using electronic communication tools.
4.2. No special quorum is required for decision-making.
4.3. A decision is deemed adopted after the Executive Council summarizes the voting results and informs the participants.
4.4. In the event that amendments are adopted, the Executive Council shall:
update the text of the Agreement;
publish information on the amendments on the official Agreement activity page;
update the electronic document archive accordingly.
5. Settlement of Disputes
5.1. Any disputes or disagreements arising during the discussion of amendments or the implementation of the amended text of the Agreement are resolved by participants through negotiations.
5.2. Where necessary, issues may be submitted for consideration by the Executive Council.
5.3. The Executive Council facilitates the development of a coordinated position and ensures the organization of discussions.
6. Final Provisions
6.1. Amendments enter into force from the moment of their official adoption and notification to the participants.
6.2. These Rules may be supplemented or amended in accordance with the procedure established for amending the Agreement.
